After Godfrey v. Spano: Is new York’s High Court Ready to Recognize Out-Of-State Same-Sex Marriages?

Abstract

In the wake of a decision handed down in late 2009 New York's high court appear[ed] poised to recognize same-sex marriages legally contracted in other states. Professor Gulino examines that decision-- Godfrey v. Spanoas -- well as its implications for future recognition by the Court of Appeals of out-of-state same-sex marriages, the rule of law that will likely serve as the basis for such recognition, and a factual scenario that would put the issue squarely and unavoidably before the Court.
